TERMS OF SERVICE – VIFORMY

Welcome to Viformy.com. This Terms of Service Agreement (“Agreement”) governs your access to and use of the websites, applications, and services (collectively, the “Services”) provided by Viformy.

By installing our apps or using our Services, you agree to be legally bound by these terms. If you do not agree to these terms, please do not use our Services.

1. Our Services

Viformy develops eCommerce applications designed to enhance your online storefront.

Scope: We provide standard apps, custom development, and webmaster services.
Support: We use commercially reasonable efforts to provide technical support for our own Services. We are not responsible for third-party products or services.
Modifications: We reserve the right to modify, update, or disable features of our Services at any time without prior notice.

2. Payments, Billing, and Taxes

Per Store Basis: Subscriptions are required for each individual store. One subscription cannot be shared across multiple Shopify stores.
Currency: All payments are processed in USD (United States Dollars).
Taxes: Prices do not include applicable sales, GST, or other governmental fees. You are responsible for all taxes associated with your purchase.
Chargebacks: You agree to indemnify Viformy against any costs or fees resulting from payment disputes or chargebacks initiated by you.

3. Trial Periods

We may offer a trial period for certain Services.

You are bound by this Agreement during the trial.
If you do not uninstall the app before the trial expires, you will be automatically charged based on the predefined billing cycle.

4. Intellectual Property

Ownership: Viformy owns all rights, titles, and interests in the Services, including source code, design, and content (“Our Content”).
License: We grant you a limited, non-exclusive, revocable license to use the Services solely for operating your online store.
Restrictions: You may not copy, modify, reverse engineer, or redistribute our source code or content without express written permission.

5. Third-Party Content and Services

Risk: Your use of third-party services (like Shopify) or third-party content is at your own risk.
No Liability: Viformy is not a party to the relationship between you and your customers or you and your eCommerce platform provider. We are not liable for any errors or damages caused by third-party services.

6. Cancellation and Refund Policy

No Refunds: All sales are final. We do not offer refunds once a billing cycle has been processed.
Easy Cancellation: You may cancel at any time by simply uninstalling the app. Your next invoice will automatically be adjusted.
Data Deletion: Upon termination, personal data tied to your account will be deleted or anonymized within 60 days.

7. Limitation of Liability

To the maximum extent permitted by law:

Viformy and its affiliates shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data).
Our total liability for any claim shall not exceed the amount you paid for the Services in the 12 months preceding the claim.

8. Acceptable Use

You agree not to use our Services to:

Engage in any unlawful, fraudulent, or harmful activity.
Post or transmit defamatory, obscene, or threatening material.
Distribute viruses, spyware, or malicious software.
Conduct automated data collection (scraping) without consent.
Impersonate any person or entity.

9. Governing Law and Jurisdiction

This Agreement is governed by the laws of Vietnam. Any disputes arising from these terms or your use of the Services shall be subject to the exclusive jurisdiction of the competent courts in Hanoi, Vietnam.
